GENERAL TERMS AND CONDITIONS (GTC) – STARWAY Inc
applying to services created, offered, sold and operated by Sirius Travel Management; service trade mark of
Starway Inc.; 3445 Stratford Rd NE; Atlanta GA 30326, in the further text referred to as “The Company” and
its clients, in further text referred as “The Client”.
Rights and Obligations:
1. The Company offers its services such as travel, tours, accommodation, transportation, meals, visits,
sightseeing, shows, events, meetings, incentives and conferences in the form of a comprehensive
service package which specifies services included.
2. Service package is performed by own staff or by contractors and thus it consists of a number of
agreements and contracts with individual service contractors.
3. Service package is offered to clients with essential elements, service content, price, and time .
4. Service package may be offered to clients in its entirety or as particular individual services.
5. Offer and acceptance of the service package can be made by parties who are present or remote,
directly or indirectly by means of mail, electronically by email, fax, phone.
6. Acceptance of an offer within a deadline makes a binding agreement between parties. An offer
accepted after a deadline is no more valid, and is subject to availability and reinstatement.
7. Service package price is an essential part of any offer and agreement. A failure to pay the agreed
service package price by a deadline may result automatically in cancellation of services.
8. Client has right of recission if negotiated with the Company and its affected service suppliers.
9. Client has right to cancel any time before deadline and before binding agreement was concluded.
10. Partial or full cancellation of services after a deadline is not refundable after the cancellation
deadline, and may bear penalties and/or damages towards the Company and its contractors.
11. Prices quoted include VAT and usual local city taxes. The payments are usually executed by bank
transfers or credit cards using the time of receipt for meeting the deadline.
12. The Company acts as the intermediary between corporate, business, government or individual
clients referred to as “Client”, and individual business contractors as direct service providers.
13. The Company is bound by all individual service contracts included in the Service Package.
14. The Company reserves the right to substitute a service with a similar of the same kind and quality,
should the original one become unavailable due to circumstance beyond its control.
15. The Company is not deemed responsible or liable for a loss or damage caused by unforeseen and
unforeseeable circumstances or “Vis Majeure” beyond its control.
16. The Company is not deemed liable for any loss or damage incurred by its contactors, traffic
disruptions, delay of means of transportation, accidents, business hours, government action, action
by immigrations customs officials, theft or loss of personal documents or belongings, medical
17. The Company performs all services in professional manner and in good faith according to contract,
agreement, correspondence and trade good business practice.
18. Any claims expressing dissatisfaction or requests for refund for services not provided as agreed
must be submitted 7 days after the service and substantiated by proofs.
19. All correspondence is done electronically unless otherwise requested or regulated by applicable.
20. The payment of the Service Package means acceptance of GTC – General Terms and Conditions and
this Agreement in its entirety.
Data Protection:
Discretion is one of the basic tenets of the Company. The Company respects the privacy of its
clients and adheres strictly to all applicable data protection laws and more. Personal data collected in
the registration procedure are used solely for the purpose of executing the respective order. The
Company does not disclose any personal details of its clients to third parties.
Applicable Law: The USA law applies. Parties should try to resolve all disputes by direct negotiation.
Unresolved disputes will be referred the AAA American Arbitration Association, and/or American Court.
